Oregon applies a strict formula when determining child support for each party. The child support is based on a formula in an online calculator called the Oregon Child Support Guidelines Calculator. The calculator provides an estimate and is based on each parity’s parenting time, gross income, health care costs for the children, childcare costs. The final amount the calculation provides after input of each factor is not the guaranteed final amount. A judge, administrative law judge, or court will then have the final authority to determine the amount of the final child support order. In determining the final amount of child support, the court will take into consideration rebuttal factors presented by each party to either increase or decrease the guideline child support calculation.

Discovery is the term used to describe the exchange of information between the parties in a case. While discovery can add to the costs and complexity of family court litigation, it is an important undertaking to find each of the relevant factors for the child support calculation when reaching either an initial amount, or when attempting to deviate from the initial amount. Oregon allows either party to request a modification of the child support order following 35 months since the last order was entered or reviewed. The court has found in the past that a significant change in circumstances that will allow a modification to the child support orders includes, but is not limited to:

  • Change in physical custody of the child
  • Change in needs of the child
  • Change in income of one or both parents of the child
  • Change in number of children involved
