OREGON ANNULMENT ATTORNEY

Qualifying for an Annulment In Oregon

In Oregon, ORS 107.015 regulates annulments. Specifically, grounds for annulment or dissolution of marriage exist when:

  • either party to the marriage was incapable of making the marriage contract or consenting to the marriage for want of legal age or sufficient understanding; or
  • the consent of either party was obtained by force or fraud.

The courts have distinguished the two grounds through the distinction of void versus voidable.

Void Marriages. A void marriage exists when one spouse was still married to someone else at the time of the current marriage or the marriage is to a close relative by blood or adoption.

Voidable Marriages. A voidable marriage through the annulment process occurs when one of the spouses to the current marriage did not sufficiently understand what was happening, one of the parties was too young to fully understand what was happening, one of the party’s consent was obtained by force or through fraud.

A marriage that qualifies for one of the above reasons is no longer valid or in effect as of the time the judgement is signed by the Oregon judge.
