Before filing for a divorce, parties often wonder how they will get by when they have not worked for a significant period of time so that they could support the family or if they have been out of the work force  so that the other party could advance their career. In theses, and more, circumstances, the court has the authority to award spousal support to one party. Often this is also referred to as alimony. Regardless of the title, the court will look at the marriage and the parties respective positions when making a ‘just and equitable’ award of that may include spousal support for one party. The court will look to the parties’ circumstances, including earning capacities, at the time of the divorce in making its determination of amount and the duration of the award as well as other factors enumerated in ORS 107.105.

Various Types of Spousal Support

Transitional.  Transitional spousal support is awarded to enable one party to attain education and training necessary to allow the party to prepare for reentry into the job market or for advancement in the workforce. ORS 107.105(1)(d)(A).

Maintenance. The goal of maintenance spousal support is to enable the parties to live separately at a standard of living comparable to that enjoyed during the marriage, to the greatest extent possible. Maintenance support is often awarded for either a distinct period of time or indefinitely. In determining the length and amount, the court will weigh the eleven factors as listed within ORS 107.105(1)(d)(C).

Compensatory. Compensatory spousal support is proper when the court determines that one party has made a significant financial or other contribution to the education, training, vocational skills, career or earning capacity of the other party. ORS 107.105(1)(d)(B).

Additional factors the court will weigh for each include, but are not limited to each parties health and ability to work.
